Terms & Conditions

Family Planning NSW Shop is the distributor of books and other products produced by Family Planning NSW (ABN 75 000 026 335). The Terms and Conditions set out below are the Terms and Conditions under which Family Planning NSW Shop will supply goods to the Customer.

Terms and Conditions apply to the exclusion of any other terms or conditions which may be contained on the Customer’s order or elsewhere. Only the Chief Executive Officer or Financial Director has the authority to vary these Terms and Conditions.

Payment policy

Payment

The Customer must pay in full for orders placed with Family Planning NSW Shop on credit within 30 days of receipt of the order confirmation/tax invoice.

Family Planning NSW Shop has the right to cancel any order not paid within 30 days of order placement unless agreed otherwise.

Orders will only be shipped once payment is received in full.

Payment method

Payment can be made online by credit card (VISA or MasterCard), Debit Card or through PayPal. These are the preferred payment methods.

Offline payments for organizational customers can be made through an Electronic Funds Transfer (EFT) or direct credit to the below bank details:

Immediate Payment

Despite any other Terms and Conditions, the Customer must pay all outstanding amounts in either of the following events:

  • Individuals purchasing goods will not be supplied goods on credit. Full payment is required prior to shipping of any orders.
  • Individuals breaching any terms and conditions of this agreement.

Stop supply

If payment is not received by the due date, the Customer will be placed on stop supply without notice until payment is received in full, including any applicable interest. On the second or subsequent occasion a Customer is placed on stop supply, Family Planning NSW Shop may without further notice refuse to supply the Customer on credit.

Collection Costs

The Customer must pay in full any costs incurred by Family Planning NSW Shop to collect outstanding amounts, including, without limitations, the fees of any agents or solicitors appointed by Family Planning NSW.

Pricing policy

Pricing and Currency

Our prices are in Australian dollars and include Goods and Services Tax (GST). All goods are invoiced at the Recommended Retail Price (RRP) less any discount agreed between the Customer and Family Planning NSW Shop. Postage and handling and applicable GST (for orders within Australia) are itemized on the invoice.

Disputed amounts

The Customer will advise the Family Planning NSW Shop in writing by email to shop@fpnsw.org.au of any disputer invoices or accounts within 7 days or receiving the invoice.

Supply of Orders

Goods ordered are supplied subject to availability.

Family Planning NSW Shop is not liable for any loss or damage resulting from a failure to supply and reserves the right to reduce the size of any order where goods are out of stock, in short supply or otherwise not available.

Shortages

All claims for shortages must be received in writing by email from Family Planning NSW Shop (shop@fpnsw.org.au) no later than 7 working days from receipt of goods and must specify the relevant invoice number and the details of the shortage.

Shipping and delivery

Delivery Timelines

Family Planning NSW Shop will attempt to deliver goods within 14 days of receipt of Customer order payment.

Postage & Handling

Postage of goods is via Australia Post. All postage charged for domestic and international orders are based on Australia Post charges.

Products which are free to download are subject to an additional handling charge of $5.00.

Return/refund policy

Returns

Goods may only be returned for refund to Family Planning NSW Shop with a returns authorization, after receiving written notification within 7 working days of the invoice date from the Customer.

Return privileges are offered to facilitate the buying decision as part of a mutually beneficial trading relationship. Family Planning NSW Shop reserves the right to amend or revoke these return privileges. Family Planning NSW Shop will not authorise returns on firm sale articles such as contraceptive and sexually transmissible infection kits and pamphlets. At all times Family Planning NSW complies with the Australia Consumer Law.

1. Returns Authorisation

Only returns authorised by Family Planning NSW Shop will be accepted.

2. Packaging of Authorised Returns

The Customer must return the goods well packaged in parcels or cartons which are clearly labelled and NOT by Return To Sender mail in original packaging. A copy of the Returns Authorisation form must be included in the package.

3. Unacceptable Returns

Goods will be returned to the Customer at the Customer’s cost if they are:

  • Unauthorised returns;
  • Not accompanied by the Return Authorisation form;
  • A firm sale article (non-returnable);
  • Goods that are damaged due to incorrect returns packaging;
  • Good that are not in resalable condition

4. Refund for Returns

All adjustments for returns will be by way of a refund of funds to the same mode of payment.

Damaged or Defective Goods

Family Planning NSW Shop will replace, subject to availability, (freight free) damaged or defective goods which are returned to Family Planning NSW Shop. Goods damaged in transit will be replaced or refunded only if Family Planning NSW Shop is notified of the damage within 7 working days from the receipt of goods.

Goods refused

If a Customer refuses delivery of goods ordered by the Customer, Family Planning NSW Shop is entitled to payment by the Customer of an amount determined by Family Planning NSW Shop to recover Family Planning NSW “Shop” administration and other costs and loss of profits.

Free Products

Most free resources are only available to registered organisations in NSW, Australia. Orders will not be supplied without an organisation name, address, telephone number and email address. For any further inquiries, please contact our Health Promotion team via email: healthpromotion@fpnsw.org.au.

A nominal postage charge is applied to each order.

1. Quantity Limits

Most free promotional resources have quantity limits to ensure an equitable distribution among recipient organisations. The limits for each item are stated on the page description for that resource.

2. Restrictions

Health promotion resources are only available to registered organisations in NSW, Australia. This is often a function of our funder’s requirements. We regret that quantity orders outside this area cannot be sent. However, if you live outside NSW, Australia, and wish to receive a sample for professional evaluation, please contact our Health Promotion team via email: healthpromotion@fpnsw.org.au.

3. Fulfillment time frames

Please allow up to 28 days to receive your order.

Risk

Goods are at the Customer’s risk from the time of:

  • The passing of goods to the Customer, or
  • The physical delivery of the goods to the Customer or such person or premises as the Customer directs, whichever comes first.

Family Planning NSW Shop may use your personal information to keep customers informed of products and information that may be of interest. Customers may op-out of direct marketing at any time by notifying Family Planning NSW Shop via email: shop@fpnsw.org.au.
